1. Agreement to Terms

Welcome to the Evermore Weddings website ("Site"). This Site is owned and operated by Evermore Weddings ("Evermore," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "client") and Evermore, governing your use of our Site and the engagement of our wedding planning services (collectively, the "Service"). By using our Site or entering into a client agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

2. Our Service and Scope of Work

Evermore provides luxury wedding planning, design, and coordination services. The specific scope of services, deliverables, and timelines for each client will be detailed in a separate, formal Client Service Agreement. These Terms of Service provide a general framework for our professional relationship. We reserve the right to refuse service to anyone for any reason at any time.

3. Client Engagement and Payments

To engage our services, clients are required to sign a formal Client Service Agreement and provide a non-refundable retainer fee. This retainer secures your wedding date in our calendar. The full payment schedule and terms will be explicitly outlined in your individual agreement. All payments are processed via secure methods detailed in our invoicing. You agree to provide current and accurate information for all engagements and to promptly update your information as needed.

4. Intellectual Property Rights

All original content created and provided by Evermore, including but not limited to design concepts, mood boards, planning documents, timelines, custom floor plans, and all content on this Site (the "Evermore Content"), is the exclusive property of Evermore Weddings. This content is protected by copyright and other intellectual property laws. You are granted a limited license to use these materials for the sole purpose of planning your wedding with us. You may not reproduce, duplicate, sell, or otherwise exploit our proprietary materials for any commercial purpose without our express written consent.

5. Third-Party Vendors

As part of our service, we recommend and coordinate with various third-party vendors (e.g., florists, caterers, photographers). While we pride ourselves on our curated network, we act as your agent in these interactions. Your contractual relationship is ultimately with each individual vendor. Evermore is not responsible or liable for the performance, quality of work, or failure to perform by any third-party vendor. We do not provide warranties for their services and are not liable for any loss or damage arising from their actions or omissions.

6. Cancellation Policy

Our cancellation policy is detailed in the Client Service Agreement. Due to the nature of our work and the reservation of our time for your event date, all retainer fees are non-refundable. Cancellations must be submitted in writing. The specific terms regarding payments and refunds upon cancellation will be governed by your signed agreement.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVERMORE WEDDINGS, ITS DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, RESULTING FROM (A) YOUR USE OF OUR SERVICE; (B) THE ACTIONS OR OMISSIONS OF ANY THIRD-PARTY VENDOR; OR (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS. Our total liability in connection with any claim arising out of your engagement with us shall not exceed the total fees paid by you to Evermore Weddings for the service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal action arising under these Terms will be brought exclusively in the federal or state courts located in New York City.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will update the "Last Updated" date at the top of this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
